Terms of Service

In effect from October 15, 2026. Run by Averrion. Questions: support@averrion.com

The short version

  • Your account is yours to look after. Keep your login safe and play fair.
  • When you buy the game you get a license to play it, and we've promised how that license works, including what happens if Averrion ever shuts down.
  • The game is changing all the time. Characters can be wiped during the alpha and beta, and balance, items and content change.
  • Break the rules (cheating, abuse, fraud) and we can suspend or close your account.
  • These terms follow Oregon law.

The short version helps you read the rest; the full text below is what applies.

1.Who we are and what this covers

Averrion: Ascension (the "game") and averrion.com (the "site") are run by the independent developer of Averrion: Ascension, doing business as "Averrion" ("Averrion", "we", "us"). If the game moves to a company we form (we expect Avernix Game Studios LLC), that company takes our place in these terms and we'll say so here.

These terms cover the site, your account, the game on every platform we offer it (the desktop download, the browser version, Steam and any other store), our realms (game servers), chat, leaderboards, and anything you buy from us. We call all of that the "services".

By creating an account, buying something, or playing, you agree to these terms, the Privacy Policy, the Code of Conduct and the Purchases and Refunds policy. If you don't agree, please don't use the services.

2.Who can play

You must be at least 13 years old, or older if the law where you live sets a higher age to use online services without a parent's permission. If you are under 18 (or the age of majority where you live), a parent or guardian must agree to these terms for you and is responsible for your use, including purchases.

You can't use the services if the law where you live forbids it, or if we have closed an account of yours before for breaking these terms.

3.Your account

You can sign in with an averrion.com account (email and password) or with a login from a partner we support, such as Lich Souls, Steam or another platform. However you sign in, it's one Averrion account, and what you own belongs to that account.

Keep your login details private. You are responsible for what happens on your account. Tell us right away at support@averrion.com if you think someone else is using it.

Accounts are personal. Don't sell, trade, share or give away your account, and don't buy someone else's. We may refuse to help with, or close, accounts that change hands.

Character names, lobby names and anything else you choose must follow the Code of Conduct. We can change or remove names that don't.

4.Your license to play

The game, its code, art, music, story, characters and everything else in it belong to us or to the people who license them to us. When you get the game, you get a personal, non-exclusive, non-transferable, revocable license to install it and play it for your own non-commercial entertainment, under these terms. You don't buy the software itself.

What your license includes depends on what your account owns: for example the base game, an expansion, or other content. We call these entitlements. Some content may only be playable if your account owns it, both online and in solo play.

Solo play works offline. The game keeps a license file on your computer and refreshes it when you sign in online, at least once every 90 days. If it can't refresh for longer than that, solo play may be limited until you sign in again.

You may not: copy, sell, rent or sublicense the game; reverse engineer, decompile or modify it except as the law allows or as we allow for mods (below); remove copyright notices; get around the license check, entitlements or anti-cheat; or use the game to build a competing product.

5.Our end-of-life promise

We mean this one. If we ever decide to shut Averrion down for good:

  • We will announce it at least six months before the online services close.
  • We will release a final update that removes the license check and unlocks every expansion for anyone whose account owns the base game.
  • Any time during those six months, start the game online once. It checks your account one last time and, if you own the base game, unlocks for good and never needs to check again.

"Own" means your account shows the base game as purchased when it checks. Refunded or charged-back purchases, and accounts closed for breaking these terms, don't count. Online features (realms, chat, leaderboards, seasons, shared stashes) end when the services close; the promise is about the game you play on your own computer.

The full explanation is on our About page.

6.Purchases

We may sell the base game, expansions, and other digital content or services, on the site and through stores such as Steam. Prices are shown before you pay. Payments are handled by payment processors (for example Stripe) or by the store you buy through; we never see or keep your full card number.

Purchases from a store like Steam also follow that store's terms and refund rules. Refunds for purchases from us follow the Purchases and Refunds policy.

If a payment is reversed, refunded or charged back, we remove what it bought from your account. Fraudulent purchases can lead to your account being closed.

7.Items, gold and progress in the game

Items, gold, characters, stash contents, rankings and other things inside the game have no real-world money value. They're part of the game we license to you, not property you own. You can't cash them out, and we don't owe you anything for them.

Trading items and gold with other players inside the game is fine. Selling, buying or trading them (or accounts, or play services like "boosting") for real money or anything outside the game is not allowed, and we can remove the items, gold or characters involved and suspend accounts.

8.The game changes

Averrion is being built in the open. During the alpha and beta, and sometimes after, we may change, rebalance, add or remove anything in the game: skills, classes, items, drop rates, areas, story and more.

Characters can be wiped. Every character is wiped before the official launch, and alpha and beta characters may be wiped along the way, sometimes without notice. Seasonal characters move to the standard ladder or end as each season says. Please don't treat test versions as a permanent save.

We may need to take realms down for maintenance and updates, and we can't promise the online services will always be available. We may require you to update the game to keep playing online.

9.Rules and enforcement

Play by the Code of Conduct. In short: no cheating, exploiting, botting, harassment, hate, scams or illegal content.

If you break these terms or the Code of Conduct, we may warn you, mute you, remove items or characters, reset progress, remove you from leaderboards, or suspend or close your account, depending on how serious it is. We try to be fair and proportionate, and you can write to us if you think we got it wrong. If we close your account for breaking the rules, you lose access to what it owned and you aren't entitled to a refund, unless the law says otherwise.

10.What you post and create

You keep whatever rights you have in what you write or create (chat messages, names, bug reports, mods). You give us a worldwide, royalty-free license to host, show, store, and use it to run, moderate and improve the services. Chat is kept for moderation, as the Privacy Policy explains.

If you send us ideas, feedback or suggestions, we can use them freely without paying you or crediting you.

Mods and add-ons: we may offer ways to change the game (add-on packages, scripts). You may make and share non-commercial mods for personal use with the tools we provide, as long as they don't include our assets beyond what's needed, don't give an unfair advantage on our realms, and follow these terms. Realms may refuse modified clients. We can withdraw this permission for any mod.

Streaming and videos: you can stream, record and post videos of you playing the game, and earn money from your videos and streams on platforms like YouTube and Twitch, as long as you don't suggest we endorse you and you follow this platform's rules.

11.Other services

Signing in with a partner (Lich Souls, Steam, others), paying through a processor or store, and links to other sites involve services we don't run. Their own terms and privacy policies apply to what they do. We aren't responsible for them.

12.No warranty

The services are provided "as is" and "as available". As far as the law allows, we make no promises that they will be uninterrupted, error-free, secure, or fit for a particular purpose, and we disclaim all implied warranties. Some places don't allow these exclusions, so some of this may not apply to you. See also the Disclaimer.

13.Limits on our liability

As far as the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress, lost profits or lost goodwill. Our total liability to you for any claim about the services is limited to the greater of what you paid us in the 12 months before the claim, or 50 US dollars.

Nothing in these terms limits liability that can't be limited by law, such as for fraud, or rights you have as a consumer that can't be waived.

14.If you cause a claim against us

If someone makes a claim against us because of something you did in breach of these terms or the law, you agree to cover our reasonable costs of dealing with it, as far as the law allows.

15.Ending the agreement

You can stop using the services and ask us to delete your account at any time (see the Privacy Policy). We can end these terms for you, or stop offering some or all of the services, as described above and in the end-of-life promise. The parts of these terms that by their nature should last (ownership of the game, limits on liability, the promise) continue after the agreement ends.

16.Law and disputes

These terms are governed by the laws of the State of Oregon and of the United States, without regard to conflict-of-law rules. If we have a disagreement, please write to us first at support@averrion.com; most things can be sorted out that way. If not, disputes will be handled by the state or federal courts located in Oregon, and you and we agree to their jurisdiction.

If you live in the European Union, the United Kingdom or another place whose consumer laws give you the right to go to your local courts, or protect you in ways that can't be signed away, you keep those rights.

17.Changes to these terms

We may update these terms as the game grows. If a change matters, we'll tell you on the site, by email, or in the game before it takes effect. If you keep using the services after that, you accept the new terms. Changes don't apply to disputes that started before them.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given up the right to. You can't transfer these terms to someone else; we can transfer them to a company that takes over the game (such as Avernix Game Studios LLC).
